π’ Choosing the Right Business Structure Could Save You Tax!
Did you know that the legal structure you choose for your business can have a significant impact on the amount of tax you pay?
Here are some common business structures and their tax considerations:
π€ Sole Proprietor
βοΈ Simple and cost-effective to operate.
βοΈ Business profits are taxed in your personal name at the individual tax rates.
βοΈ You are personally liable for business debts.
π’ Private Company (Pty) Ltd
βοΈ Pays tax at the corporate income tax rate.
βοΈ Offers limited liability protection.
βοΈ Shareholders may also be subject to Dividend Withholding Tax when profits are distributed.
π€ Partnership
βοΈ The partnership itself does not pay income tax.
βοΈ Each partner is taxed individually on their share of the profits.
π‘οΈ Trust
βοΈ Can be useful for asset protection and estate planning.
βοΈ Tax treatment depends on whether income is retained in the trust or distributed to beneficiaries.
βοΈ Requires careful planning to ensure tax efficiency.
π‘ There is no "one-size-fits-all" solution. The best structure depends on your business goals, expected profits, asset protection needs, succession planning, and long-term tax strategy.
Before starting a new businessβor restructuring an existing oneβspeak to a tax professional to ensure you're using the most suitable structure.

π‘ While the 3rd provisional payment is optional, it can save you money if your taxable income was higher than originally estimated.

π Travel Allowance vs Right of Use β What's the Difference?
Many taxpayers think these are the same, but they're taxed differently by SARS.
β
Travel Allowance
You use your *own vehicle* for business travel, and your employer pays you a travel allowance to help cover your motoring expenses.
βοΈ The allowance is reflected on your IRP5.
βοΈ You may be able to claim a business travel deduction if you keep a valid logbook.
π Right of Use (Company Vehicle)
Your *employer provides* you with a company-owned or company-leased vehicle for your use.
βοΈ A taxable fringe benefit is included in your salary each month.
βοΈ If you use the vehicle for business purposes, you may still qualify for tax relief, provided you maintain an accurate logbook.
π The key difference?
β‘οΈ Travel Allowance = You own the vehicle and receive an allowance.
β‘οΈ Right of Use = The company owns or leases the vehicle and provides it to you as an employment benefit.
β οΈ In both cases, an accurate logbook is one of the most important documents when submitting your tax return to SARS.

π Do you receive a Travel Allowance or use a Company Vehicle? Here's what SARS needs! π
If your IRP5 reflects a Travel Allowance or a Right of Use of a Motor Vehicle (Company Car), you'll need more than just your IRP5 when submitting your tax return.
β
Make sure you have:
π A completed logbook for the full tax year (1 March β 28 February)
π Your vehicle's opening and closing odometer readings
π The total business and private kilometres travelled
π Supporting documents for vehicle expenses (where applicable), such as:
β’ Fuel
β’ Maintenance & repairs
β’ Insurance
β’ Licence fees
β’ Finance lease tax certificate
β οΈ No logbook = No business travel deduction.
Many taxpayers miss out on valuable tax deductions simply because they don't keep an accurate logbook throughout the year.

π‘ Provisional Tax vs Income Tax β What's the Difference?
Many taxpayers think provisional tax is a separate tax⦠but it isn't! Here's the difference:
π Income Tax
Income tax is the tax you pay on your taxable income for the tax year. Your final tax liability is calculated when you submit your annual Income Tax Return to SARS.
π Provisional Tax
Provisional tax is not an additional tax. It is simply a system that allows certain taxpayers to pay their income tax in advance during the year, rather than in one lump sum after year-end.
You may need to register as a provisional taxpayer if you:
βοΈ Earn rental income
βοΈ Are self-employed
βοΈ Receive freelance or consulting income
βοΈ Earn investment income above the prescribed thresholds
βοΈ Have other income that is not subject to PAYE
β οΈ Missing provisional tax deadlines or underestimating your taxable income can result in penalties and interest from SARS.
Not sure whether you're a provisional taxpayer or if you've calculated your payments correctly?
