Rental losses don't always reduce your taxable income immediately. Many taxpayers believe that just because they are investing in their rental property, and maybe even losing money, that they get a tax benefit. It is often never the case due to passive loss limitations.

However, did you know that your passive losses can offset other streams of passive income?

Let's review your suspended losses.

Real Estate Professional Status (REPS) can be an important part of real estate tax planning—but qualifying for REPS is only part of the equation.
For qualifying taxpayers, REPS combined with material participation may allow certain rental real estate activities to be treated as nonpassive rather than passive. In some circumstances, this may allow losses from those activities to offset other income, such as W-2 wages or active business income.

But what does material participation actually mean?
The IRS provides several tests for determining whether a taxpayer materially participates in an activity. For example, you may qualify if you:

⏱️ Participate in the activity for more than 500 hours during the tax year.

👥 Your participation constitutes substantially all of the participation in the activity.

📊 Meet one of the other IRS material participation tests based on the amount, consistency, and nature of your involvement.

Simply owning a property, making occasional decisions, or having REPS status does not automatically establish material participation.
That’s why keeping detailed records of your hours, activities, and involvement throughout the year can be an important part of your tax-planning strategy.
Do you know if you qualify for REPS—and whether you meet the material participation requirements?

Did you know that Real Estate Professional Status (REPS) may help qualifying taxpayers unlock significant tax-planning opportunities?

REPS is a tax status for individuals who are actively involved in a real property trade or business. However, it’s not simply a title you give yourself, specific IRS requirements must be met.

To meet the basic REPS requirements, you generally must:

🏡 Spend more than 750 hours during the tax year participating in real property trades or businesses in which you materially participate.

⏱️ Spend more than 50% of your total personal service time during the tax year in real property trades or businesses in which you materially participate.

Meeting these two tests is an important first step, but REPS status alone does not automatically make all rental real estate losses nonpassive. Material participation and other passive activity rules may also apply.

Could REPS be relevant to your tax-planning strategy? Let’s review your situation and determine whether you may qualify.

A 1031 exchange can be a valuable tool for eligible real estate investors, but it requires planning and proper ex*****on.

If you're considering selling an investment property, make the tax conversation part of the process from the beginning.

Did you know that if you sell your property on your own, and invest the proceeds into another like-kind property without the appropriate structure (not hiring a qualified intermediary, not meeting other timing requirements & more) you will likely face capital gains tax on the appreciation of your investment.

Our team structures 1031 transactions and helps you plan through all the potential pitfalls.

Give us a call if you are considering a 1031 exchange.
