Debunking 4 Myths About the New RetirePath Virginia Expansion

Myth 1: "It’s only for companies with 25+ staff."
FALSE. As of July 1, 2026, the threshold dropped to 5+ employees (including part-time team members).

Myth 2: "This is going to cost my business money."
FALSE. RetirePath is 100% free for employers. Businesses do not pay admin fees, nor do they match employee contributions.

Myth 3: "I already offer a 401(k), so I don't need to do anything."
FALSE. If you receive a state notification, you must log into RetirePathVA.com using your assigned access code to certify your plan exemption.

Myth 4: "My employees are forced to contribute."
FALSE. Participation is completely voluntary. Employees have a 30-day window to customize their savings rate or opt out entirely before deductions start.

Attention Virginia Small Business Owners: The RetirePath threshold just changed.

As of July 1, 2026, Virginia's state-facilitated retirement law expanded. The eligibility limit dropped from 25 employees to just 5 employees, including part-time workers. If your company has been open for 2+ years, has 5 or more eligible staff, and doesn't offer a qualified retirement plan, you need to act.

Roughly 35,000 businesses are receiving notices with state access codes.

Key Registration Deadlines:
📅 Sept 30, 2026: Businesses with 10–24 employees
📅 Oct 30, 2026: Businesses with 5–9 employees
