Tax Tip Tuesday – June 2, 2026
A recent federal tax case, commonly referred to as the Kwong Decision (Kwong v. United States), may affect millions of taxpayers.
Did You Pay IRS Penalties or Interest During the COVID Period?
If you paid IRS penalties or interest between January 20, 2020, and July 10, 2023, you may be entitled to a refund.
The National Taxpayer Advocate has indicated that millions of taxpayers could potentially qualify if the ruling ultimately stands.
Why This Matters
The court found that certain IRS actions during the COVID disaster period may have been improper, potentially giving taxpayers the right to recover penalties and interest they paid during that time.
Important Notes
This area of law is still developing:
The IRS has not officially conceded the issue.
Appeals are expected.
Some penalties may qualify while others may not.
International information return penalties (Forms 5471, FBAR, etc.) may be outside the scope of the ruling.
Claims may need to be filed by July 10, 2026 to preserve your rights.
What Should You Do?
Review your IRS records and determine whether you paid any penalties or interest between January 20, 2020, and July 10, 2023.
