U.S. owners of foreign corporations should take note of a recent IRS update to Form 5471 reporting.
On September 14, the IRS updated the Schedule E (Form 5471) instructions to address new foreign tax allocation reporting following the repeal of the one-month deferral election under IRC §898(c)(2).
For certain affected CFCs, foreign income taxes may need to be allocated between the corporation's first required year and its succeeding tax year. Additional supporting statements may also be required.
Form 5471 compliance can change significantly based on ownership, entity classification, tax year, foreign taxes, and elections. Businesses and individuals with foreign corporate interests should review these requirements before year-end rather than waiting until return preparation.
