IRS PENALTY WAIVER
Taxpayers who file or pay taxes late may qualify for a penalty waiver under IRS's first-time abatement program. The agency will approve a waiver of late-filing and late-payment penalties for filers who pay or arrange to pay the tax due and have been tax-complaint for the past three years. Penalties for delinquent returns of S corporations or partnerships and for late payroll-tax deposits are also eligible for the waiver.
But the estimated-tax penalty can't be abated under this program. Currently, taxpayers need to request abatement over the phone or via mail.
IRS will soon begin to automatically provide first-time penalty abatement to taxpayers who qualify for relief. The agency is on the cusp of launching its plan to automatically abate penalties, according to IRS's National Taxpayer Advocate. And we're told the program's name will change to automatic exemption of penalties, or AEP. Filers will get a letter informing them that IRS didn't assess a penalty.
