📢 IRS Update for 2025 W-2s & 1099s: Penalty Relief
In early November, the IRS released Notice 2025-62, granting employers and payors a one-year transition period (for 2025 only) as we shift into the new reporting rules created under the One, Big, Beautiful Bill Act (OBBBA) — the law behind the new “no tax on tips” and “no tax on overtime” deductions.
What this means for 2025:
✔️ No penalties if you don’t separately report:
• Cash tips
• Employee occupation
• Qualified overtime pay
…on Forms W-2/1099 and related information returns, as long as aggregate wages/reportable amounts are still reported correctly and on time.
✔️ Relief applies only to tax year 2025.
✔️ Employers are encouraged (but not required) to provide employees additional detail on tips & overtime (Box 14 or an online portal) to help them claim the new deductions on their 2025 returns.
🔜 Mandatory reporting begins in 2026, so 2025 is the year to prepare.
