🚨 PART 2: CAN THAT $850,000 LAWSUIT PAYMENT ACTUALLY BE WRITTEN OFF?

Now, I already know what somebody is thinking:

“Well, if the business has to pay $850,000, they can just write it off on their taxes.”

Not so fast! A write-off does not mean the business gets the entire $850,000 back. It only means an allowable deduction may reduce the business’s taxable income.

Born United agreed to pay $850,000 related to claims including trademark infringement, false designation of origin, unfair competition and unjust enrichment. Because this was a dispute between private businesses not a fine paid directly to the government the payment may potentially qualify as a business deduction. But the final answer depends on the actual judgment, settlement language and what each portion of the payment represents.

Here is how we would look at it CC:

Stop calling everything a write-off. If it wasn’t ordinary and necessary for the business, leave it alone. 👀
