Mom died owing $38,000 on credit cards, and collectors are calling her kids. Who really pays?

Estate Pays, Not You: Debts are settled from the deceasedβs estateβbank accounts, property, and assets. If funds are insufficient, leftover debt usually goes unpaid; family members typically arenβt personally liable.
Exceptions to Watch: You may owe if you co-signed, are a joint account holder, a spouse in certain states, or mishandle estate duties under state probate laws.
Medicaid & Estate Recovery: Medicaid can claim the estate for care costs if your parent was 55+; protections exist for surviving spouses or minor/disabled children. Always check state rules before selling property.
