One of our clients is moving out of her single-family home of 40 years and relocating to a senior living facility. The reason for the move is not because she is mentally incapable of managing the house, rather she is becoming more feeble and thus increasingly susceptible to suffer a fall or succumb to a medical emergency.

Since she began working with us, she has grown her portfolio significantly thus allowing her to be able to afford the $6,000 monthly rent without going into principal, enabling her to avoid selling her home at this time and offering her the luxury of being able to return should she not be comfortable at the facility.

To protect her assets, we structured a deal co-naming her son on the deed, so he will solely inherit the house at a stepped-up basis upon her death. However to be fair to her other children, we amended her will so the son's share of the estate will be reduced by the value of the house at date of death, thereby keeping the other children whole in equal distribution of her estate.
