Considering an IRS Offer in Compromise?

Before recommending one, I review whether your tax returns and payments are current—and how the IRS will evaluate your assets, income, and collection deadlines.

For example, being unable to borrow against your home does not automatically exclude its equity from the analysis.

My latest blog explains what I check before recommending a settlement:

Before the IRS considers an Offer in Compromise, you have to meet its eligibility requirements.

A landscaper referred to me had already submitted his own offer. He completed the forms carefully and proposed an amount he thought he could afford.

But he was missing a required tax return and hadn't made his required estimated tax payments.

The IRS returned his offer without considering the proposed settlement. His first step needed to be getting current.

Taxpayers generally must file all required returns and make estimated tax payments that are due. Employers must also make required federal tax deposits for the current quarter and the two preceding quarters. Taxpayers in an open bankruptcy are not eligible.

I review these requirements before recommending an offer. Then I evaluate the financial facts to determine whether a settlement makes sense.

If you're considering an Offer in Compromise, contact me for an evaluation of your eligibility and financial circumstances.

IRS guidance:

An offer in compromise allows you to settle your tax debt for less than the full amount you owe.
