🧬 Georgia Sales Tax Update: DNA Testing Services
Georgia tax authorities have ruled that standalone DNA testing services are not subject to sales tax.
For providers, the distinction matters: while the testing service itself is not taxable, providers are responsible for use tax on the physical collection kits consumed as part of the testing process.
💡 Why It Matters: Businesses offering DNA testing services in Georgia should review how they purchase and account for testing kits to ensure use tax is being handled correctly.
Sales tax rules can vary significantly depending on whether a transaction involves a taxable product, a nontaxable service—or both.

Giving away inventory purchased tax-free for resale may still create a tax obligation.
When a Colorado business removes products from its tax-exempt wholesale inventory and uses them for promotional giveaways, the business generally becomes the final consumer and owes use tax based on the original purchase price.
Selling through a marketplace? A compliant marketplace facilitator generally handles sales tax collection and remittance for transactions completed through its platform. However, sellers making direct sales through their own websites, stores, or other channels must continue monitoring Colorado’s $100,000 economic nexus threshold.
Key reminders:
🔹 Promotional giveaways may trigger use tax
🔹 Tax is based on the wholesale purchase price
🔹 Credit may be available for qualifying tax paid to another state
🔹 Marketplace facilitators generally collect tax on platform sales
🔹 Direct and multichannel sellers have separate nexus considerations
🔹 Colorado home-rule cities may impose additional requirements
Need help evaluating your Colorado sales and use tax obligations? Davis Davis & Harmon LLC can help.

California Sales & Use Tax Guidance Updated for Interior Designers and Decorators
The California Department of Tax and Fee Administration has revised Publication 35, clarifying how sales and use tax applies to interior design services, merchandise, labor, installations, construction contracts, and purchases for resale.
Key reminders:
* Professional design fees may be nontaxable when unrelated to merchandise sales.
* Fees connected to selling furnishings or other merchandise are generally taxable.
* Fabrication labor is generally taxable, while qualifying installation and repair labor may not be.
* Special rules apply when designers furnish or install items attached to real property.
* Nontaxable services should be separately stated on client invoices.
Interior designers and decorators operating in California should review their contracts, invoicing practices, and tax treatment to ensure compliance with the updated guidance.
Need help determining how these rules apply to your business? Contact Davis Davis & Harmon LLC, the Sales Tax Experts.
