On December 26, 2018, the Employment and Training Administration (ETA) of the Department of Labor (Department) issued its Federal Register Notice to announce the 2019 Adverse Effect Wage Rates (AEWRs). This notice applies to the employment of temporary or seasonal nonimmigrant foreign workers (H–2A workers) to perform agricultural labor or services.
AEWRs are the minimum wage rates the Department has determined must be offered and paid by employers to H–2A workers and workers in corresponding employment for a particular occupation and area so that the wages of similarly employed U.S. workers will not be adversely affected. The new AEWRs are effective January 9, 2019.
After two years of successive declines, the Arizona AEWR has jumped again, from $10.46 (effectively $10.50 under the state’s 2018 minimum wage) to $12.00 per hour.
California’s AEWR goes to $13.92, up from $13.18 per hour. After enjoying a drop last year, Colorado employers will be among three states to see the largest percentage increase in the country (22.8%), up from $10.69 to $13.13 per hour. New Mexico H-2A users will see a jump from $10.46 to $12.00 per hour.
California employers currently under an H-2A contract will have to increase the minimum wage rates loaded into their payroll systems for workers now in the field effective January 9.
Western Growers is helping to support the efforts of the National Council of Agricultural Employers to pursue litigation that would “pause” the AEWR increase, and direct an interagency study of the underlying issues of whether there is an adverse effect on domestic workers due to utilization of H-2A workers, and if so, what measures might be justified to address it.

United States Customs and Immigration Services (USCIS) announced that it has begun using email to send receipt and approval notices to H-2A petitioners. In addition, USCIS is now using pre-paid overnight mailers provided by H-2A petitioners to send any requests for evidence (RFE) issued in a case.
While the state workforce agencies and the U.S. Department of Labor have long used email to correspond with H-2A applicants, USCIS has been the last agency in the H-2A process to embrace the modern era. The use of paper mail has been a constant cause of delay and source of consternation among H-2A users due to the highly time-sensitive nature of the H-2A petition process. For this reason, Western Growers staff and voluntary leadership, and industry allies, have met with USCIS leadership in Washington D.C. on several occasions to persuade the agency to embrace email notifications.
USCIS said that in addition to sending notifications of receipt and approval by email, H-2A petitioners will be able to submit two pre-paid mailers to expedite delivery of both the final decision notice and any RFE issued for the petition. In the past, USCIS Service centers have used pre-paid mailers only for final decision notices.

The Farm Labor Housing Direct Loans and Grants program now allows for funding for non-citizen temporary worker housing, including housing for H-2A program participants. The deadline to submit pre-applications is August 27, 2018.
Previously, the program had been limited to housing for permanent residents and U.S. citizens. Now, not-for-profit entities can utilize the loan program to build or improve housing for a temporary labor force, a revision in the law created by an amendment offered by U.S. Representative Dan Newhouse (WA-4) in the Consolidated Appropriations Act of 2018 (P.L. 115-141).
A not-for-profit subsidiary of farmers, associations of farmers, or family farm corporations may apply for this federal loan program for construction, improvement, repair and purchase of housing for farm labor in either urban or rural areas. Loans will have a fixed interest rate of 1% with a 33 year payback period. Not-for-profit and government entities can apply for grants that are based on need but may not exceed 90% of the total project cost.
The United States Department of Agriculture (USDA) is authorized to extend approximately $30 million annually toward the program, with individual awards as high as $3 million. Payments on these labor housing loans are typically made from tenant rent payments, with an available rent subsidy from the USDA. Given the increasing competition for farm labor, this program may be a cost-effective way to expand or improve housing options to aid in attracting workers.
The Farm Labor Housing Loans and Grants program has a two-phased application process. First, those interested must submit pre-application to their respective state’s development office by Monday, August 27, 2018. From the pool of pre-applications, selected applicants will be notified by the USDA and will receive further guidance regarding the final stage of the process.
