The Bureau of Internal Revenue has released ๐๐๐ ๐๐จ. ๐๐-๐๐๐๐ to provide additional guidance on the implementation of ๐๐๐ฏ๐๐ง๐ฎ๐ ๐๐๐ ๐ฎ๐ฅ๐๐ญ๐ข๐จ๐ง๐ฌ (๐๐) ๐๐จ.
The Circular explains key implementation concerns, including the application of the 0.5% CWT on qualifying purchases from manufacturers and direct importers for wholesale, the documentary requirements needed to establish a supplier's status, and the proper interpretation of transactions considered "intended for wholesale."
It also provides guidance on the correct withholding tax treatment for transactions involving motor vehicles (CBU and SKD), motorcycles, pharmaceutical products, and solid and liquid fuels, as well as the appropriate remedies when an incorrect withholding tax rate has been applied.
Through this issuance, the BIR seeks to ensure the consistent implementation of the regulations, help taxpayers and withholding agents comply with their obligations, and promote the proper application of withholding tax rules in covered transactions.
