COURT OF APPEALS HOLDS CHINABANK LIABLE IN MULTI-MILLION PESO TRUST FUND FRAUD

📌 WHAT HAPPENED?

The Court of Appeals (13th Division) has upheld a Manila Regional Trial Court decision ordering China Banking Corporation (Chinabank) to pay nearly ₱70 million in restitution and damages to a couple who lost millions through an alleged trust fund fraud involving branch personnel.

WHO WERE THE VICTIMS?
━━━━━━━━━━━━━━━━━━

Spouses Remigio and Elvira Godoy, long-time Chinabank depositors at the Blumentritt branch.

According to court records, they were persuaded by branch personnel to transfer their savings into what was presented as a high-yield trust fund investment.

WHAT WENT WRONG?
━━━━━━━━━━━━━━━━━━

• The couple issued several checks to an assistant branch manager.
• They received a Fund Balance Advice showing approximately ₱29.396 million.
• When the investment matured, they sought to renew it.
• The bank later informed them that no such trust fund or balance existed in its records.

WHAT DID THE COURT RULE?
━━━━━━━━━━━━━━━━━━

The Court of Appeals affirmed the lower court’s ruling, finding Chinabank liable for:

• The missing trust fund amount.
• Unauthorized account activities.
• Interest, damages, and other court-awarded compensation totaling nearly ₱70 million.

WHY IS THIS DECISION SIGNIFICANT?
━━━━━━━━━━━━━━━━━━

The ruling reinforces a long-standing principle under Philippine law:

✅ Banks cannot simply avoid responsibility by claiming an employee acted alone.

The court held that banks are expected to exercise the highest degree of diligence in safeguarding clients’ funds and may be held liable for fraudulent acts committed by employees acting within their apparent authority.
