HASiL has issued a clarification on the stamp duty and endorsement treatment for employment contracts and instruments under the 𝐄𝐱𝐞𝐦𝐩𝐭𝐢𝐨𝐧 and 𝐆𝐞𝐧𝐞𝐫𝐚𝐥 𝐄𝐱𝐞𝐦𝐩𝐭𝐢𝐨𝐧 categories.

Here’s the simple breakdown:

✅ 𝐌𝐨𝐧𝐭𝐡𝐥𝐲 𝐫𝐞𝐦𝐮𝐧𝐞𝐫𝐚𝐭𝐢𝐨𝐧 𝐧𝐨𝐭 𝐞𝐱𝐜𝐞𝐞𝐝𝐢𝐧𝐠 𝐑𝐌𝟑,𝟎𝟎𝟎
Employment contract instruments falling under the 𝐄𝐱𝐞𝐦𝐩𝐭𝐢𝐨𝐧 𝐜𝐚𝐭𝐞𝐠𝐨𝐫𝐲 do not need to be stamped or endorsed.

📄 𝐌𝐨𝐧𝐭𝐡𝐥𝐲 𝐫𝐞𝐦𝐮𝐧𝐞𝐫𝐚𝐭𝐢𝐨𝐧 𝐚𝐛𝐨𝐯𝐞 𝐑𝐌𝟑,𝟎𝟎𝟎
Only the 𝐦𝐚𝐢𝐧 / 𝐦𝐚𝐬𝐭𝐞𝐫 𝐞𝐦𝐩𝐥𝐨𝐲𝐦𝐞𝐧𝐭 𝐜𝐨𝐧𝐭𝐫𝐚𝐜𝐭 containing the employment terms and conditions needs to be 𝐬𝐭𝐚𝐦𝐩𝐞𝐝 𝐚𝐧𝐝 𝐞𝐧𝐝𝐨𝐫𝐬𝐞𝐝. Supplementary instruments relating to the same employment do not need to be stamped or endorsed.

⚠️ 𝐆𝐞𝐧𝐞𝐫𝐚𝐥 𝐄𝐱𝐞𝐦𝐩𝐭𝐢𝐨𝐧 𝐜𝐚𝐭𝐞𝐠𝐨𝐫𝐲
These instruments are exempt from stamp duty, but 𝐞𝐧𝐝𝐨𝐫𝐬𝐞𝐦𝐞𝐧𝐭 𝐢𝐬 𝐬𝐭𝐢𝐥𝐥 𝐫𝐞𝐪𝐮𝐢𝐫𝐞𝐝 to confirm that the relevant party and instrument qualify for the exemption.

Employers may wish to review their employment documentation to ensure the correct treatment is applied.

Foreign-worker quota applications are now managed digitally through the FWCMS eQuota system under KESUMA.

But a more streamlined process does not mean automatic approval. Employers still need to meet the relevant Section 60K, recruitment, documentation and labor compliance requirements.
