أصدر وزير المالية ياسين جابر قراراً يتعلق بتمديد المهل المحددة لإنجاز المعاملات العقارية نتيجة اقفال أمانات السجل العقاري العقاري اعتباراً من تاريخ 19/12/2022 لناحية استثناء بعض العقود العقارية من أحكام قانون موازنة 2022 وتحديد آلية إنجازها.
وفيه:
" وحيث أنه تعذر على المواطنين انجاز معاملاتهم لدى أمانات السجل العقاري بسبب إقفال وحدات الشؤون العقارية اعتباراً من تاريخ 2022/12/19 وعدم قدرة الادارات العامة على العمل طيلة أيام الاسبوع وخلال الدوام الرسمي،
المادة الأولى : لا تطبق احكام قانون موازنة 2022 بالنسبة للعقود المنظمة قبل 15/11/2022 والمسجلة في السجل اليومي اعتباراً من 1/1/2021 ولغاية 30/11/2022 ضمناً وذلك بالنسبة لجميع أمانات السجل العقاري.
المادة الثانية: ​تقوم الدوائر العقارية بانجاز العقود المذكورة في المادة الأولى بالاطلاع على القيمة التأجيرية الاخيرة المعطاة للقسم من خلال نظام المكننة المعتمد لضريبة الأملاك المبنية، دون الزام المواطن بضم مستند قيمة تأجيرية بعد تسديد ضريبة الاملاك المبنية الصادرة بتاريخ هذا القرار وذلك فقط بالنسبة للعقارات المبنية المفرزة أقساماً دون العقارات الغير مفرزة"."
