Dear All,

Please note the Minimum Tax case was mentioned on 12th April 2021 to seek interim conservatory orders (Injunction) and alert the Court that payment was due by 20 April 2021.

Please note that the Court did not grant the interim injunction orders on the basis that the National Assembly and ICPAK were not represented in Court and had not responded to the Petition. Despite KRA and the AG being represented in Court yesterday, they had not filed their responses to the Application for the Injunction or Petition.

In addition, KRA informed the Court of a similar minimum tax case at the Machakos High Court by the Kitengela Bar Owners expected to be heard on 14th April 2021 and requested the Court to consolidate it with the Nairobi case.

Way Forward by the Nairobi High Court:

1- The Court required all Parties to file their responses by 15th April 2021.
2- The Case will again be mentioned on **19th April 2021** for Directions from the Court on Conservatory Orders and consolidation of the cases.
