he Kolkata ITAT set aside an assessment under the Black Money Act, 2015 for the assessee, who was accused of holding undisclosed foreign assets based on unverified information from Swiss authorities. The assessee argued that the bank account documents were uncertified, unauthenticated, and incomplete. The ITAT agreed, noting that the documents were not properly certified, and the Assessing Officer failed to investigate their authenticity. As a result, the ITAT ruled that there was insufficient evidence to prove the assessee’s beneficial ownership of the foreign accounts, thus canceling the addition under the Black Money Act.
