BIG TAX UPDATE | FAST-DS 2026 NOW LIVE

Foreign Assets of Small Taxpayers – Disclosure Scheme, 2026 (FAST-DS 2026)

The Income Tax Department has now enabled Form 1 for filing on the e-Filing Portal.

WHAT IS FAST-DS 2026?

FAST-DS 2026 is a one-time compliance opportunity for eligible taxpayers to disclose certain:

🔹 Undisclosed foreign assets
🔹 Undisclosed foreign income
🔹 Foreign assets acquired while being non-resident but not subsequently disclosed
🔹 Certain foreign assets acquired from income already offered to tax in India but not reported in the relevant ITR schedule

WHO SHOULD REVIEW THEIR CASE?
Particularly relevant for:
✅ Individuals holding foreign bank accounts
✅ Foreign shares / investments
✅ ESOPs / RSUs received from overseas employers
✅ Foreign insurance policies
✅ Returning NRIs / persons who became residents
✅ Foreign assets acquired during overseas employment
✅ Taxpayers who inadvertently missed disclosure in Schedule FA

KEY MONETARY LIMITS
Category 1:
Where aggregate undisclosed foreign asset + foreign income does not exceed ₹1 Crore, specified tax/additional amount applies under the Scheme.
Category 2:
Certain foreign assets up to ₹5 Crore may qualify for a ₹1 Lakh fee, subject to prescribed conditions.

The valuation of relevant assets is linked to 31 March 2026 as the prescribed valuation date.
IMPORTANT DEADLINE
Form 1 can be filed from 16 August 2026 to 31 December 2026.

Foreign asset cases require careful examination of:
➡️ Source of acquisition
➡️ Year of acquisition
➡️ Residential status
➡️ Historical ITRs
➡️ Schedule FA disclosures
➡️ Valuation and foreign currency conversion
➡️ Supporting documents

FAST-DS 2026 therefore deserves a case-by-case professional review, especially for taxpayers with historical foreign assets or overseas income.

If you have any undisclosed foreign asset/income, this is the right time to review the position and assess eligibility under FAST-DS 2026.

Income Tax Department’s Nationwide Action on Suspicious Foreign Remittances

The Income Tax Department has launched a nationwide detailed verification exercise into suspicious outward foreign remittances involving shell entities and questionable transactions.

Key findings highlighted by CBDT:
• Several entities remitted large amounts of foreign exchange despite reporting very small turnover or being non-filers.
• Remittances did not appear to match the stated purposes such as freight, software or consultancy services.
• Many entities were reportedly not operating from their declared addresses.
• A large number of Form 15CB certificates were issued by a relatively small group of professionals.
• Remitted funds were received by a clustered group of entities.
• The verification exercise covers approximately 394 entities, including 117 entities located in land-border States, and 36 professionals.
A very important message for professionals

Form 15CB is not merely a procedural certification.

An Accountant certifying a foreign remittance is expected to verify the taxability of the remittance with reference to books of account and relevant supporting documents and exercise proper due diligence, professional judgment and care.
“Certification” means responsibility.
This development is a strong reminder for every professional handling Form 15CB/Form 146:
