No One Is Telling You!

The Maternity Benefit Act 2017 protects working women in India across all establishments with 10 or more employees, mandating 26 weeks of paid maternity leave for the first two children and 12 weeks for subsequent children.

This includes full pay during leave, a mandatory medical bonus, and job security meaning termination or demotion due to pregnancy, marriage, or the assumption of pregnancy is illegal.

Employers are also required to provide crèche facilities in workplaces with 50+ employees, nursing breaks post-delivery, and may allow work-from-home options post-maternity leave by mutual agreement.

The law extends support to adoptive and commissioning mothers, provides relief for miscarriage or medical pregnancy termination, and offers additional leave for postpartum illnesses.

Despite strong legal protections, pregnancy discrimination is widespread, often disguised as increased workload, unfair performance plans, or forced resignations aimed at avoiding maternity benefit payments.

To fight discrimination and secure your rights:

1. Document all evidence - Work emails, project assignments, communication records, performance reviews, and any discriminatory remarks. Recording conversations for your protection is legally permissible.

2. File complaints with these authorities simultaneously:

- National Commission for Women (NCW) via [ncwapps.nic.in]

- SAMADHAN Government Portal via [samadhan.labour.gov.in]

- State Labour Commissioner office in your region

- Submit Form G Appeal under the Maternity Benefit Act for direct redress

3. Employers violating these rights are subject to criminal penalties: imprisonment up to one year, fines up to Rs 5,000, and liability for back wages and damages.

Remember, you do not have to officially announce your pregnancy to be protected. Discrimination based on the mere assumption of pregnancy or marriage is also illegal and punishable.

Understanding these detailed rights and remedies empowers women to take action confidently and ensures workplaces uphold dignity, equality, and legal compliance.
