An estate is the property and assets a person owns. In legal and financial contexts, it usually means everything they leave behind when they die - such as a home, savings, investments, and personal belongings, after debts and expenses are taken into account.

It may be possible, but do not assume it will continue as normal.

Each bank has its own policies. Once told that one account holder has lost capacity, a bank may restrict the account or require further arrangements to protect that person’s money.

A joint account is not a substitute for a Lasting Power of Attorney (LPA). An LPA can give a trusted person clear legal authority to deal with financial decisions if capacity is lost.

Planning ahead can help avoid uncertainty at a difficult time.

A Lasting Power of Attorney should be registered with the Office of the Public Guardian as soon as it has been completed.

It cannot be used until registration is complete — and the process can take several weeks.

Registering early means it is ready if it is ever needed, whether because of illness, injury or a change in circumstances.

You do not need to wait until someone loses mental capacity. In fact, planning ahead while you can make your own decisions is the best time to put an LPA in place.

An EPA is an older legal document that allowed someone you trust to make decisions about your property and financial affairs.

You can no longer make a new EPA in England and Wales — they were replaced by Lasting Powers of Attorney (LPAs) in 2007.

However, an EPA made and signed before 1 October 2007 may still be valid. If the person who made it starts to lose mental capacity, it must be registered with the Office of the Public Guardian before it can continue to be used.

For new arrangements, an LPA is now the appropriate option.

In the context of a Lasting Power of Attorney (LPA), an attorney is the person you choose to make decisions for you.

They may help with your property and finances, or with your health and welfare — depending on the type of LPA you make.

An attorney must act in your best interests and follow the principles of the Mental Capacity Act.

Choosing someone you trust is an important part of planning ahead.

The Court of Protection is a specialist court in England and Wales. It makes decisions for people who cannot make certain decisions for themselves because they lack mental capacity at that time.

It can make decisions about health and welfare, property and finances, appoint deputies, and deal with matters involving Powers of Attorney.

Its central aim is to ensure decisions are made in the person’s best interests while respecting their rights, wishes and independence wherever possible.
