HMRC is consulting on a new criminal offence for reckless, untrue tax statements. What could it mean for taxpayers and businesses?
The Government is proposing a new criminal offence for making reckless untrue statements or declarations relating to direct taxes, such as Income Tax and Corporation Tax. The aim is to align the rules with those already in place for VAT and other indirect taxes, giving prosecutors an alternative charge where dishonesty cannot be proven but reckless behaviour is evident.
Importantly, this proposal is not aimed at genuine mistakes. Instead, it targets situations where individuals or businesses act recklessly when providing information to HMRC.
If introduced, the new offence could carry:
โ A custodial sentence of up to two years
โ An unlimited fine
โ Greater consistency across the UK tax system
Our latest news article explains the proposals, who they could affect and what they may mean for taxpayers, business owners and advisers.
