Employ staff? October brings employment law changes your business needs to know about.

• Since 1 October, the time limit for most Employment Tribunal claims has increased from three to six months, making accurate employment records even more important.

• From 30 October, employers must take “all reasonable steps” to prevent sexual harassment, alongside stronger responsibilities to protect staff from harassment by customers, contractors and other third parties.

Now is a good time to review your policies, check that managers know how to handle concerns, and make sure complaints are properly recorded and investigated.

Could HMRC collect unpaid tax through monthly deductions from your bank account?

Under new proposals, HMRC could recover certain persistent tax debts from individuals and companies that can afford to pay in instalments but repeatedly fail to respond to HMRC.

The proposals include debt limits, advance notice and affordability checks. They are still under review, so the details are not final rules.

We explain what’s being proposed and what it could mean for you or your business.

Can an inheritance be changed after someone dies?

In some circumstances, yes. A Deed of Variation allows a beneficiary to redirect all or part of their inheritance to another family member, another beneficiary or a trust.

If the tax conditions are met, HMRC can treat the change as though the assets had been left that way by the person who died. This may reduce Inheritance Tax or avoid certain Capital Gains Tax consequences.

For the variation to receive this tax treatment:

• It must be completed within two years of the death
• It must be made in writing
• Anyone receiving less as a result must agree
• It must include the correct Inheritance Tax and Capital Gains Tax statements

A Deed of Variation can also be used when someone dies without a will, but it does not automatically result in a tax saving. The impact on the whole estate and everyone affected should be considered first.

Ion Partners Accountant can explain the tax implications, calculate the potential effect and work alongside your solicitor before the variation is completed.

Failing to notify HMRC is not the same as submitting a tax return late.

A “failure to notify” happens when you do not tell HMRC that a new tax liability has arisen. For example, when:

• Your business exceeds the VAT registration threshold
• Your company becomes liable for Corporation Tax
• You start receiving taxable income from self-employment or investments

The penalty is calculated as a percentage of the unpaid tax. The maximum can be:

• 30% for a non-deliberate failure
• 70% for a deliberate failure
• 100% if the failure was deliberate and concealed

The final penalty also depends on whether you contacted HMRC voluntarily, how quickly you acted and how much you cooperated. An unprompted disclosure can result in a significantly lower penalty.

If you had a reasonable excuse, HMRC may not charge a penalty, provided you notify them promptly once the circumstances preventing you from doing so have ended.

Ion Partners Accountant can review your situation, calculate the outstanding tax and help you make a complete disclosure to HMRC.

An interest-free company loan is not always tax-free.

If your company lends money to an employee or director without charging interest, or charges less than HMRC’s official rate of 3.75%, the difference may become a taxable benefit.

If the outstanding balance exceeds £10,000 at any point during the tax year, the small loan exemption may no longer apply.

Ion Partners Accountant can review the loan, calculate any taxable benefit and make sure your P11D and National Insurance reporting is correct.

Do you know when your limited company needs to register for Corporation Tax?

Once your company starts trading or receiving income, you normally need to inform HMRC within three months. If it has not started trading, it may be considered dormant, but Companies House filing requirements still apply.

Ion Partners Accountant can check your company’s status, complete the Corporation Tax registration and help you meet the correct deadlines.

💷 Did you know HMRC could owe you money?

It's more common than you might think. You may have paid too much tax if you've:
• changed jobs;
• had work-related expenses you didn't claim;
• overpaid tax for other reasons.

If you've paid more tax than necessary, you could be entitled to a tax refund.

📩 Not sure if you can claim a refund? Get in touch with the team at Ion Partners Accountants and we'll help you check.
