Getting sick can be unavoidable, no matter how hard you try 🤒 If you can’t work because you’re sick and you’ve already used all your sick leave, you can ask to use your accrued annual leave to cover the time off.

The standard rules for annual leave apply. You need to request annual leave before going on leave and your employer needs to agree to it. Your employer can’t unreasonably refuse your request.

Your award, enterprise agreement, company policy or employment contract will usually set out the process for requesting annual leave.

Small business employers aren’t usually required to pay redundancy pay to employees who are made redundant.

However, as of 15 December 2023 under new laws, a non-small business that becomes a small business due to downsizing its workforce leading up to insolvency might still be required to pay their employees redundancy pay under the NES in certain situations.

This can include where the business is bankrupt or in liquidation and has become a small business because they’ve terminated the employment of 1 or more employees in the period leading up to (or after) bankruptcy or liquidation.
