OWN A HOLIDAY HOME OR AIRBNB? FROM 1 JULY 2026, YOUR RENTAL DEDUCTIONS MAY NOT WORK THE SAME WAY AS BEFORE

If you own a property that is rented through Airbnb or Stayz but is also used by your family for weekends or holidays, there is a change from 1 July 2026 worth knowing about.

The ATO has updated its approach to properties that may be considered a “leisure facility”, which can include holiday homes.

The important issue is whether the property is used or held for use mainly to produce rental income.

For example, you may own a coastal holiday home that is listed on Airbnb during the year, but your family also regularly uses it on weekends, over Christmas, during school holidays, or keeps some of the most desirable periods unavailable for private use.

Many owners may assume this is simply a matter of dividing expenses between rental days and private-use days.

From 1 July 2026, for properties caught by these rules, the issue can go further than simply apportioning the expenses.

If the property is not used mainly to produce rental income, holding costs such as loan interest, council and water rates, strata or body corporate fees, repairs and maintenance may not be deductible.

Direct costs incurred in earning rental income, such as Airbnb or booking fees, advertising and cleaning after guests, may still be deductible.

Simply listing a property on Airbnb and making it “available for rent” therefore does not automatically make all of the property's interest and holding costs tax deductible.

Where the property is genuinely used mainly to produce rental income and there is only some private use, deductions may still be available, subject to the appropriate adjustment for private use.

For clients with holiday homes or short-term rental properties, Taxnually recommends keeping clear records of actual rental dates, periods when the property was genuinely available for rent, dates used by the owner or family, and periods blocked out from rental.

Those records will become increasingly important when determining whether the property was genuinely held mainly to produce rental income.

If your property is both an investment and somewhere your family regularly holidays, don't wait until Tax Return time to start reconstructing your Airbnb calendar.

FOREIGN BUYER FINED $508K AS ATO FORCES 111 PROPERTY SALES

A foreign investor has been fined $508,000 by the Federal Court after failing to comply with the conditions attached to the purchase of vacant residential land in Australia.

The investor purchased vacant land in Victoria in 2011 and was given approval to buy the property on the condition that a home was built on the land within four years. However, the land remained vacant after the required timeframe and the ATO eventually took the matter to the Federal Court.

The ATO also obtained freezing orders over the property during the proceedings.

According to the ATO, its foreign investment compliance program has dealt with 217 breaches, including 111 residential properties that have been forced to be sold.

For foreign buyers, the important point is that approval to purchase property in Australia can come with conditions that still need to be followed after the purchase.

For example, if a foreign investor is approved to purchase vacant residential land, there may be a condition requiring a home to be built within a certain period.

If you have previously purchased property in Australia as a foreign person, particularly vacant land that has not yet been developed, it may be worth checking the original approval and the conditions attached to it.

General information only. Foreign investment requirements depend on the purchaser, the property and the conditions of the particular approval.

[ENGLISH]
BUYING A VEHICLE THROUGH YOUR COMPANY — CAN YOU CLAIM 100%?

This is a question Taxnually comes across quite often, particularly when a business owner is considering a new vehicle and wants to know whether it is better to purchase it personally or through the company.

A common assumption is that if the company pays for the vehicle, the invoice is in the company's name and the vehicle is registered to the company, the full purchase price and related costs can be claimed.

Having the vehicle in the company's name is only one part of the tax treatment. You also need to consider how the vehicle is used, any private use, GST, depreciation and FBT.

For example, a company may purchase an $80,000 vehicle that a director uses to visit clients and for other business travel, but the director also drives it home, goes shopping and uses it on weekends. The company may be entitled to deductions under the relevant rules, but the director's private use can potentially give rise to Fringe Benefits Tax (FBT).

A logbook is also an important part of the records that business owners should consider from the time they start using the vehicle.

Where a logbook is used to establish the business-use percentage, it generally needs to cover at least 12 continuous weeks and be representative of the vehicle's normal use. Records include journeys, their purpose, opening and closing odometer readings and kilometres travelled. A valid logbook can generally be used for five years, unless the vehicle's usage changes materially.

Another point to keep in mind is that a company spending $80,000 on a vehicle does not mean the entire $80,000 can immediately be claimed to reduce taxable profit in that year. A vehicle is an asset, so the deduction available depends on the applicable depreciation rules. For passenger vehicles, the car limit can also restrict the depreciation deduction and GST credit available.

The ATO is also continuing its motor vehicle data-matching program. For vehicles newly registered or transferred with a purchase price or market value of $10,000 or more, the ATO can receive information from motor vehicle registration authorities.

The data collected can be quite detailed, including purchase or sale price, market value, registration details, garage address and intended use. The ATO expects the program to collect information relating to around 2.5 million individuals each financial year.

This does not mean purchasing a vehicle worth more than $10,000 will automatically lead to an ATO audit. It does, however, show how much information the ATO may have available to compare against what a business reports in its BAS and Tax Return.

If you are considering a significant vehicle purchase for your business, Taxnually generally recommends discussing it with your accountant before making the purchase, particularly where tax planning is part of the decision.

The question is not simply “Can I claim it if I buy it through the company?” You should also consider how much can be claimed, the business/private-use percentage, what logbook records are required, whether FBT applies, and how GST and depreciation will be treated.

MUA INVESTMENT PROPERTY CHUNG HAI VỢ CHỒNG, NGƯỜI INCOME CAO HƠN CÓ THỂ CLAIM HẾT RENTAL LOSS KHÔNG?Đây là câu hỏi Taxnu...
25/09/2026

BUYING AN INVESTMENT PROPERTY TOGETHER - CAN THE HIGHER-INCOME SPOUSE CLAIM ALL THE RENTAL LOSS?

This is a question Taxnually comes across quite often, particularly where there is a significant difference between the incomes of two spouses.

For example, one spouse earns $180,000 and the other earns $60,000, and they purchase a negatively geared investment property together.

Because the higher-income spouse is in a higher tax bracket, it may seem attractive to allocate 80% or even 100% of the rental loss to that person.

Generally, you cannot simply choose the percentage at tax time.

If the property is legally owned 50/50, the rental income and expenses generally also need to be allocated 50/50 according to the legal ownership.

Even if one spouse actually pays the mortgage or most of the property expenses, that does not automatically change how the rental income and deductions are allocated for tax purposes.

Where a property is held as tenants in common, for example 70/30, the rental income and expenses will generally follow those ownership percentages.

Negative gearing rules will change from 1 July 2027, but the current rules continue to apply until then. Investment properties already held before 7:30pm AEST on 12 May 2026 are grandfathered and can continue under the existing negative gearing arrangements until the property is sold.

If you acquire an established property after that time, the current negative gearing rules can still apply until 30 June 2027. From 1 July 2027, losses on these properties will generally only be available against residential property income and can be carried forward, rather than being deducted against salary or other income. Eligible new builds receive different treatment and can continue to access negative gearing.

This is why ownership should still be considered before purchasing the property, particularly where spouses have significantly different incomes.

However, tax savings from negative gearing should not be the only consideration. Future income, CGT when the property is eventually sold, asset protection, estate planning and the longer-term plan for the property may also be relevant.

And if the property has already settled with 50/50 ownership, changing the ownership later is not simply a matter of changing a percentage on the Tax Return - CGT, stamp duty and legal costs may need to be considered depending on the circumstances.

If you are planning to purchase an investment property with your spouse, this is something worth discussing with your accountant and solicitor before signing or settlement, rather than at the end of the financial year.

[ENGLISH]
WORKING AS A CONTRACTOR? THE ATO MAY ALREADY KNOW SOME OF YOUR INCOME BEFORE YOU LODGE YOUR TAX RETURN

If you work as a contractor in industries such as IT, construction, cleaning, courier, road freight or security, there is a change this financial year worth knowing about.

Businesses in certain industries are required to lodge a Taxable Payments Annual Report (TPAR) with the ATO, reporting payments they have made to contractors.

The TPAR includes details about the contractor and payments made during the year, including the contractor's name, ABN, address, total amount paid and GST.

For example, if you work as an IT contractor for a company and it pays you $110,000 during the year, including $10,000 GST, the company may report your ABN and the $110,000 contractor payment to the ATO through its TPAR.

So by the time you prepare your Tax Return, the ATO may already have information about some of your business income directly from the businesses that engaged and paid you.

From this financial year, the ATO is starting to use TPAR information to pre-fill Tax Returns for around 700,000 sole traders and individuals in business, covering approximately $21 billion in contractor payments.

Pre-fill can make it easier to check your income, but the amount the ATO has is not necessarily your complete business income.

You may work for other customers whose payments are not reported through TPAR. The pre-filled information should also be checked against your invoices, bank transactions and accounting records to make sure your income is reported correctly and not duplicated.

This is also a good example of how the ATO can now receive information from different sources and match it against Tax Returns. For contractors, keeping complete invoices and business records throughout the year is becoming increasingly important, rather than trying to work out how much you received from each customer at tax time.

17/09/2026

[ENGLISH]

NEW CGT RULES: OWN AN INVESTMENT PROPERTY? DO YOU NEED A VALUATION BEFORE 1 JULY 2027?

There has been quite a bit of discussion recently about property investors preparing valuations ahead of the new CGT rules commencing from 1 July 2027. Some property valuers are also expecting to be very busy next year as investors look to establish the market value of their properties around the transition date.

For clients holding investment properties, Taxnually's view is that this is something worth knowing about and preparing for, but there is no need to rush into obtaining a valuation just yet.

The reason valuations are getting attention is that the way CGT is calculated will change from 1 July 2027. Capital gains accruing before this date will retain the existing 50% CGT discount treatment, while gains accruing after this date will move to the new rules based on an inflation-adjusted cost base and a minimum 30% tax rate.

For example, you may have purchased an investment property many years ago for $600,000, and by July 2027 the property has a market value of around $1.2 million. If you later sell it for $1.5 million, the capital growth before and after 1 July 2027 will no longer receive the same tax treatment.

For properties that have been held for many years and already have significant capital gains, the market value around the transition date could therefore become an important record for the future CGT calculation.

However, this does not mean you need to arrange a valuation today or have a valuer attend the property on exactly 1 July 2027.

Property valuers have noted that retrospective valuations (valuing a property as at an earlier date) are quite common. A valuation may also be prepared around July 2027 when there are sufficient comparable sales to support the market value. However, if you wait another 5-10 years before trying to establish the July 2027 value, the process may become more difficult and potentially more expensive.

For Taxnually clients, the advice at this stage is fairly simple:

👉There is no need to rush into obtaining a valuation just yet. However, if you are holding an investment property with a significant unrealised capital gain, Taxnually will look at the need for a valuation as part of tax planning before 1 July 2027.

👉In the meantime, make sure you retain your purchase contract, settlement statement, stamp duty, legal fees, and records of renovations and capital improvement costs. Don't focus only on the valuation and forget about these documents — they can also have a direct impact on your future CGT calculation.

👉And one final point: investors will have two options - use the ATO default formula at no cost, or obtain a professional valuation from a Certified Practising Valuer (CPV), which may cost up to around $1,400. If you choose a professional valuation, it should reflect the property’s market value and be supported by appropriate market evidence, including comparable sales.

There is still plenty of time to prepare. For a property you may hold for 10-20 years, getting the records right now is much easier than trying to reconstruct everything in the year you eventually sell.
