Payment dispute? There may be a faster way than going to court.

You have done the work and the invoice is overdue. With costs up and margins tight, the last thing a Sunshine Coast contractor needs is months of court and legal bills.

In Queensland, the Building Industry Fairness (Security of Payment) Act 2017 gives you another option: adjudication.
Swipe through for what to know:

• No signed contract? You may still be covered. The Act recognises written, oral, and partly written and partly oral contracts.
• Your emails, quotes, pricing schedules, site records and photos can make or break your claim.
• Payment claims must be clear, and strict timeframes apply.
• A respondent generally cannot add new reasons for withholding payment that were not in their payment schedule.
• If an adjudicated amount still is not paid, it can be registered as a court judgment.

In a recent Queensland case, an electrical subcontractor with no single signed contract was awarded the full progress claim plus interest, and the other side was ordered to pay 100% of the adjudication fees.

Owed money for work you have done? Our Litigation & Dispute Resolution Team, including Jesse McCrea, can tell you whether adjudication is the right path for you.

Buying or selling on the Sunshine Coast? Check what "fixed fee" actually covers before you sign.

With prices where they are, nobody needs a surprise invoice at settlement. Plenty of headline quotes leave the real costs until later.

Our genuine fixed fee conveyancing includes the things that usually sit outside the headline price:
• Standard searches
• PEXA fees
• Reasonable contract amendments
• Settlement extensions

And you also get:
• The complete cost upfront, in writing
• A named conveyancer looking after your matter
• A real human response within 1 business hour of every new enquiry
• If something in our standard scope is missed, we absorb it

Already have a quote? Send us your contract or your quote and we will compare the cost.

No signed contract? You may still have rights.

Our Litigation & Dispute Resolution team recently acted for an electrical subcontractor in a Queensland adjudication with no formal contract. The terms were established through emails, previous dealings and unit-rate schedules, and the adjudicator awarded the full progress claim plus interest.

Swipe through to see how it came together, then read our full article: Security of Payment Adjudication in Queensland.

Strict time limits can apply, so early advice matters. Talk to our Litigation & Dispute Resolution team on 07 5444 1022.

No written contract? You may still be able to recover payment.

We recently acted for an electrical subcontractor in a Queensland security of payment adjudication after a builder disputed payment for completed work. With no formal contract, the terms were established through emails, previous dealings and unit rates. The adjudicator awarded the full progress claim, plus interest, and the other party also bore the adjudication fees.

Do you know the difference between a Parenting Plan and a Court Order?

A Parenting Plan is a written agreement between separated parents covering things like living arrangements, time with each parent and how decisions about school, health and other matters will be made. What often surprises people is that a Parenting Plan isn't legally enforceable. It records what both parents have agreed to, but it is different from a parenting order made by the Court.

If both parents agree and want their parenting arrangements to be legally enforceable, they can then apply to the Federal Circuit and Family Court of Australia for Consent Orders.

If you're navigating parenting arrangements and want to understand your options, our Family Law team is here to help.

Big changes are coming for employers who rely on restraint clauses.

The Federal Government has released draft legislation that would significantly change the rules around non-competes and employee restraints.

Non-competes: Employers generally would not be able to stop employees earning at or below the high-income threshold, currently $190,100, from joining a competitor or starting a competing business.

Poaching staff: The draft would also ban clauses preventing former employees from approaching their former colleagues to join them elsewhere.

Clients: Client non-solicitation clauses are not being abolished, but employers will need to show they protect a legitimate business interest and are reasonable and no broader than necessary.

What can employers do? The changes do not mean employers will be left without protection. It may become even more important to tighten confidentiality and information protection clauses, carefully draft client restraints, and review notice and other contractual protections. Existing employment agreements should therefore be reviewed before the reforms commence.

The reforms are still in draft form and are expected to commence in 2027.

If your employment contracts contain restraint clauses, now is a good time to review them. Contact our employment law team on 07 5444 1022 to discuss your current contracts and restraint strategy.
