If your business runs through a family trust with a company sitting behind it, something changed in June that most owners still have not heard about.
The High Court decided that money your trust owes a company beneficiary is not automatically a loan under Division 7A. Sixteen years of annual loan agreements and repayment schedules, undone in one judgment. The ATO has accepted it and is withdrawing its old determination.
Before you go looking for those documents to throw out, one warning. If you already have loan agreements in place, they are still loans, and they still need servicing. Unwinding them on your own can create a bigger problem than the one you are fixing.
We have written the plain English version for Melbourne owners, including what is proposed for 2028 and the dates worth putting in the calendar now.
