The Government has released its first draft of legislation on the proposed 30% minimum tax for discretionary trusts - and there's a new way to avoid it.
The headline change: trusts can now nominate their beneficiaries and lock in fixed distribution percentages to sidestep the 30% tax altogether.

The Federal Budget's tax reforms are shifting - and it's worth knowing what's changed.
After months of lobbying, the Government has agreed to several amendments to the draft legislation. Our Tax Partner Tim explains what it means: the CGT discount will still apply to start-up investments and a wider band of small businesses, testamentary trusts are now excluded from the new trust tax rules, and SMSFs are set to lose the ability to borrow for residential property purchases.
