Did you know that from 1 January 2025, employers who intentionally underpay their staff could face criminal prosecution?

To help small businesses navigate these changes, the Fair Work Ombudsman has released a guide to paying employees correctly. The Voluntary Small Business Wage Compliance Code is designed for businesses with fewer than 15 employees, offering practical advice on compliance and protections under the Code.

It’s a great resource for small business owners to ensure their teams are paid fairly while protecting their business.

The ATO recommends that businesses use digital record keeping where possible, particularly as they are moving towards digital reporting for tax and super.

Keeping digital records will make some tasks easier and save you time once you have your system set up. The ATO will accept electronic images of paper records, where the copies are a true and clear reproduction of the original paper record.

Our team can help set you up with a digital solution.

Appropriate storage and backup of your digital or paper records is important, as well as storing them in a way that prevents damage or change.

Whether you have digital or paper records, always ensure you have a backup – this may include secure off-site storage, or digital cloud storage.

Digital records must also be on a computer or device that you have:
* Access to (including all passwords).
* Backed up in case of computer failure.
* Control the information on (the information you process, enter and send).

Every employer must pay their employee’s superannuation, and it’s important that you set up your business correctly from the outset.

Employees may choose for you to make payments into a chosen/existing super fund, however where no super fund has been chosen, you can contribute their super to a default super fund that you set up.

The 5 steps you must take to set up your business so you can pay your employees' super:

1. Select your default super fund.
2. Offer employees a choice of super fund and keep records that show you've done this.
3. Request your employee’s stapled super fund details if they do not make a choice.
4. Provide employees' TFNs to their funds.
5. Set up your systems to pay super contributions electronically to the right fund.
