What Does the Tax Code Really Say About IUL?
There is a lot of conversation online about Indexed Universal Life insurance and phrases like “tax-free retirement income.”
But what does the tax code actually say?
In my recent episode of Beyond the Tax Return™ — Protecting the People Behind the Numbers, I broke down some of the tax rules behind IUL in plain language, including:
• How cash value can grow on a tax-deferred basis
• Why policy loans are not the same thing as “free money”
• How life-insurance death benefits are generally treated for federal income-tax purposes
• What a Modified Endowment Contract (MEC) means
• Why the way an IUL is designed and maintained matters
The goal was not to tell anyone that an IUL is right or wrong for them.
The goal was to help people understand what they are actually buying and how the tax rules work before making a decision.
Because when it comes to life insurance, the phrase “tax-free” rarely tells the whole story.

🏢 “But My Business Pays the Premium…”
Does that automatically make the life-insurance premium tax-deductible?
No.
A business writing the check does not automatically create a tax deduction.
With business-paid life insurance, you still need to look at questions such as:
Who owns the policy?
Who is insured?
Why was the policy purchased?
Who ultimately receives the benefit?
That last question can make a major difference.
So before assuming:
“My business paid it, so I can deduct it,”
take a closer look at how the policy is actually structured.
Paying through the business ≠ automatic deduction.
Understanding the structure before tax time can prevent a costly assumption.

💡 Is Life Insurance Tax-Deductible? It Depends on the Situation.
There is no single answer that applies to every life-insurance policy.
Consider these four very different arrangements:
1️⃣ Personal life insurance
You purchase the policy for your family’s protection.
The premium is generally not personally deductible.
2️⃣ The business is the beneficiary
The business owns or benefits from the policy.
The premium is generally not deductible.
3️⃣ Life insurance secures a business loan
The policy may be required or connected to financing.
That still does not automatically make the premium deductible.
4️⃣ Employee life-insurance coverage
The business provides coverage for employees and is not the beneficiary.
Now the tax treatment can be different, and a business deduction may be available depending on the arrangement.
The key lesson:
Don’t ask only, “Is life insurance deductible?”
Ask:
Who owns the policy?
Who pays the premium?
Who is insured?
Who benefits from the policy?
Because with life insurance, structure matters.

🏢 Business Purpose Does Not Automatically Mean Tax Deduction
A business can have a very legitimate reason for purchasing life insurance—and the premium still may not be tax-deductible.
Consider key-person life insurance:
The business owns the policy.
The business pays the premium.
A key employee is insured.
And the business receives the proceeds if that employee dies.
There is clearly a business purpose for the coverage.
But that does not automatically make the premium deductible.
That is why one of the most important questions with business-owned life insurance is:
Who ultimately benefits from the policy?
The fact that an expense is important to the business does not, by itself, determine its tax treatment.
Business purpose ≠ automatic deduction.
Before assuming a life-insurance premium belongs on the business tax return, understand how the policy is structured.

🏦 Does a Business Loan Make Your Life-Insurance Premium Tax-Deductible?
Not automatically.
A lender may require life insurance as part of a business loan arrangement, but that does not necessarily mean the premium becomes a deductible business expense.
That distinction matters.
In this short clip from Episode 3 of Beyond the Tax Return™, I explain why:
Required for the loan ≠ automatically deductible
And this is only one of several life-insurance tax situations covered in the full episode:
Can You Actually Deduct Life Insurance on Your Taxes?
We also look at:
• Personal life-insurance premiums
• Business-owned policies
• Key-person insurance
• Employee life-insurance benefits
• The $50,000 group-term life-insurance rule
• Why who owns, pays for, and benefits from the policy matters
