The IRS announced a new Automatic Exemption from Penalty (AEP), replacing the old First Time Abate (FTA) process. Key points:
What it does: Automatically waives failure-to-file, failure-to-pay, and failure-to-deposit penalties for taxpayers with a clean compliance history — no request needed.
Eligibility: Taxpayer/business must have timely filed and paid for the prior 3 years (or 12 consecutive quarters for quarterly filers).
Not covered: Information returns and one-off/infrequent filings (e.g., Form 706 estate tax, Form 709 gift tax) are generally excluded.
Timeline: Rolling out this summer (2026) for tax year 2025 returns and 2026 quarterly returns. During the transition, some eligible taxpayers may still get penalty notices — they can call the IRS to request FTA manually in the meantime. AEP fully replaces FTA for returns with original due dates on or after Jan. 1, 2027.
Process: No taxpayer action required — the IRS applies it automatically and mails a confirmation notice
Doesn't cover: Tax and interest still owed; only certain penalties are waived. Taxpayers who don't qualify can still request reasonable-cause relief.
Impact estimate: The Taxpayer Advocate Service estimates AEP would have covered over 1.5 million taxpayers in FY2025, versus the ~220,000 who got relief via the manual FTA process that year.

The IRS has already sent over 1.4 million of the IRS Notices CP53E to tax payers this year as they step away from sending paper checks and encourage everyone to receive refund via direct deposit. You can respond to these notices by logging in or setting up an ID.me account and updating your bank account information. If this isn't an option, a paper check will be issued after 6 weeks. You can continue to check your refund status at https://www.irs.gov/refunds.
