Conservatorships
More can be learned about Conservatorships by following the Brittney Spears matter. https://www.npr.org/2021/06/24/1009726455/britney-spears-conservatorship-how-thats-supposed-to-work
What isn't been said enough in these conversations about Conservatorships is the following:
1. Conservatorships are divided by managing the person and/or the finances/assets of a person. The court can appoint to have only the person or only the finances managed by a Conservator.
2. A Conservatorship is used to protect and manage the finances of a vulnerable person.
3. Conservatorships are monitored through reporting to the court.
4. Licensed Professional Conservators/Guardians (Private Fiduciaries) are licensed by the state and have oversight by the state with licensing renewal requirements.
5. Appointing a Private Fiduciary as a Conservator can prevent the deterioration of family relations.
The State of California strongly believes in individual rights and does not rule in favor of a Conservatorship unless there is substantial reason to believe a person would benefit from the management and protection of a Conservator.
