CPA Sentenced to 5 Years in Prison for Tax Fraud & Identity Theft
A Las Vegas CPA, has been sentenced to five years in federal prison after pleading guilty to tax crimes costing the IRS over $3.5 million.

For a decade, he ran tax schemes targeting clients in the adult entertainment industry.
He promised clients huge tax refunds or zero tax bills with his ”special tax strategies“, charging fees of tens of thousands of dollars, paid from their IRS refunds.

How the scam worked:
▫️Faked business losses & invented expenses on tax returns
▫️Stole former employees’ identities without consent to file tax forms
▫️Continued filing fraudulent returns even after being charged

IRS warning: Tax fraud hurts all honest taxpayers. Anyone involved in fake tax planning will face severe criminal penalties.

⚠️Don’t trust so-called ”secret tax loopholes“.

🔥Inherited & sold Chinese property but missed Form 3520 for years?
Only ONE compliant fix among 3 popular approaches.

Many US citizens / green‑card holders face this cross‑border tax trap:
You inherited Chinese real estate, sold it and wired funds to the US, unaware of Form 3520 filing rules. IRS cross‑border data exchange may flag this asset later.

❌Option A: Treat sale proceeds as foreign gift | HIGH RISK
Re‑labelling inheritance sale money as a gift is false reporting. Chinese property records & bank trails reveal the truth.
Audit risk: up to 25% penalty, fraud risk, plus loss of Step‑Up Basis tax benefit.

❌Option C: Claim you owned the property originally | EXTREMELY RISKY
Ignoring inheritance facts conflicts with official Chinese land registry records.
Triggers back‑tax, interest, heavy penalties. You also forfeit Step‑Up Basis.

✅Option B: Full amended filing — ONLY valid solution
IRS 2024 update: No automatic pre‑penalty for Form 3520‑Part IV.
Penalties are likely waived for non‑willful non‑filing with reasonable‑cause statement.

4‑step remediation
1️⃣ Amend Form 3520
• Info‑return only → DIIRSP
• Unreported sale income → Streamlined Filing
File when inherited asset value > $100k at death.

2️⃣ Report capital gain (Form 8949 + Schedule D)
Use Step‑Up Basis: tax basis = property value on decedent’s death date.
Prepare death certificate, inheritance paperwork & death‑date appraisal.
Max 20% long‑term capital gain tax + possible 3.8% NIIT.

3️⃣ Foreign tax credit (Form 1116)
Offset US tax with Chinese property‑sale tax paid.
*No credit if you qualified for China’s “five‑year‑one‑home” tax exemption.

4️⃣ Back‑file FBAR & Form 8938
FBAR: aggregate foreign accounts > $10k
Form 8938: meet FATCA asset thresholds.

📎Key audit documents
• Bilingual notarized death certificate
• Inheritance notarization / court order
• Death‑date property appraisal ⭐
• Sale contract, bank statements & Chinese tax certificates

💡Takeaway
IRS offers leniency for non‑willful mistakes, but factual misrepresentation is not tolerated. Truthful amended returns with complete evidence are your safest path.

September Fed Rate‑Hike Alert!
The biggest risk for US business owners is NOT just a 0.25% rate increase.

FOMC meeting: Sep 15‑16.
Markets are pricing in a possible 25‑bp hike if inflation stays sticky.

Don’t only focus on the headline rate number.
Real pain points for your business:
• Higher business loan payments
• More expensive line‑of‑credit financing
• Rising pressure on commercial real‑estate loans
• Equipment & vehicle financing eating margins
• Compounding costs: labor, insurance, raw materials

Scariest scenario:
Higher revenue, yet less cash in your bank account.

Revenue ≠ Profit
Profit ≠ Cash Flow

Example:
$150 000 monthly revenue
5% net margin = only $7 500 profit.
Small cost increases can wipe out your profit quickly.

High‑risk business profiles:
🔹 Expanding with debt
🔹 Heavy reliance on credit lines
🔹 Trucking & transportation
🔹 Low‑margin: restaurant, beauty, retail
🔹 Planning year‑end purchases: equipment, vehicles, commercial property
Especially dangerous for variable‑rate loans.

✅ Action step: Run an interest‑rate stress test now.
List all loans, rates, monthly payments, fixed expenses, cash reserves & projected taxes.
Ask: How long can my business survive if financing costs go up further?

We don’t know if the Fed will hike in September.
But you can prepare ahead.
The real danger is getting caught off‑guard by weak cash flow after news breaks.

If you file taxes in the US — this rule will change YOUR refund next year.

On August 19, the U.S. Treasury & IRS released a major proposed rule.
It limits cash refund payouts for 4 key tax credits based strictly on immigration status.

This is NOT a new law.
It enforces the 1996 PRWORA Act:
Federal tax refund benefits only belong to qualified legal residents & citizens.

4 Credits Affected (Biggest money for families)

✅ Earned Income Tax Credit (EITC)
✅ Child Tax Credit (CTC)
✅ American Opportunity Tax Credit (AOTC)
✅ Adoption Tax Credit

The Most Important Truth ⚠️

You can still deduct & lower your taxes
But you NO LONGER get cash refund if you fail the status requirement.

How much money will you lose?

For low-to-middle income families ($20k–$40k yearly):
👶 2 kids → $6,000–$10,000 USD refund loss
👶 3 kids → Up to $13,000 USD per year

Who STILL gets cash refunds ✅

US Citizens / US Nationals
Green Card holders
Refugees & Approved Asylees

(Joint filing: only ONE spouse needs to qualify)

Who LOSES all cash refunds ❌

Undocumented / ITIN filers
H1B, F1 Visa holders
DACA & TPS recipients
Pending asylum, U/T Visa holders

SHOCKING Real Rule

Even if your kids are US-born citizens
If parents don’t have qualified status → NO cash tax refund

Timeline

Proposed Rule now open for public comment
Effective for NEXT tax season (future tax years only)
No penalty for previous filings.

⚠️ BIG CHANGE TO US TAX REFUNDS — Who can still claim cash refunds? Who cannot?
The U.S. Treasury & IRS released a proposed new rule on August 19, limiting cash‑refund portions of four refundable tax credits for certain immigrant taxpayers.

Under the proposal, the cash‑refund part (when credits exceed your tax liability) is classified as a federal public benefit under the 1996 PRWORA welfare law.

4 tax credits impacted

✅ Adoption Tax Credit
✅ Child Tax Credit (CTC)
✅ American Opportunity Tax Credit (AOTC, education)
✅ Earned Income Tax Credit (EITC)
✅ Qualified to receive cash refund

You must be, on the filing date:
• US citizen / US national
• Qualified alien: green‑card holders, granted asylees, refugees & other designated groups
For joint‑filing couples: only one spouse needs to meet above status.

⚠️ Status requiring case‑by‑case review

DACA recipients, TPS holders, asylum applicants are not automatically qualified under this rule; eligibility depends on individual immigration status & other statutes.

This rule will apply to tax years ending after the final regulation takes effect.

Public comment period opens for 45 days, public hearing requests are accepted. No official estimate on how many people will be affected.

💡 This is only a PROPOSED rule, NOT final law yet.

Important Mistakes Green Card Parents Must Avoid ❌

Getting a US green card is not the final step.

Many families lose their green card status because of these 4 common mistakes:

1️⃣ Long-term overseas stay
Over 6 months abroad = high risk at immigration
Over 1 year without a re-entry permit = possible green card loss

2️⃣ Ignoring US tax filing
No US job ≠ No tax duty
Global income (pension, rent, investments) needs proper filing.
Unfiled taxes will damage your residency status.

3️⃣ Not updating USCIS address
Address changes must be reported in time.
Missing official notices can cause application failures.

4️⃣ No naturalization plan
Green cards require continuous maintenance.
US citizenship brings stable status & full rights.

✅ A green card needs ongoing management.
Avoid these careless mistakes to protect your family’s US immigration status.

IRS Admitted Mistake & Refunded Penalty ✅ Real Client Case
Most overseas business owners believe IRS penalties are final and unavoidable — THIS IS NOT TRUE.

We successfully helped our California S-Corp client fight against an incorrect IRS penalty.

The IRS originally charged the company a wrongful fine of $13,969 USD.
After our professional tax review and official appeal submission,
the IRS officially issued a correction letter, admitted their calculation error,
fully canceled the $13,969 penalty & arranged a full refund.

Why most Chinese sellers lose money unnecessarily:

• They panic after receiving IRS letters and pay fines directly

• Ignore that IRS often makes calculation mistakes

• Leave tax notices unprocessed, leading to more late fees & audits

• Lack professional experience to file a valid appeal

Important facts for S-Corp business owners:

S-Corp (1120S tax filing) has stricter IRS inspection standards.
Any mismatched records may trigger penalties.
Every IRS fine letter has an appeal channel.
Unreasonable penalties can be legally canceled and refunded.

If you have received:
✅ IRS penalty notices
✅ 1120S audit letters
✅ tax discrepancy warnings
✅ unclear tax bills

We help you verify errors, file official appeals, and save your losses.

The US version of China’s 15th document is here: Form 1099-K reporting system fully rolled out by IRS.
Amazon, PayPal and payment processors report your gross store sales directly to IRS every year.
If your Form 1120 (for C-Corp) declared income is lower than 1099-K gross volume, you will get an IRS audit notice automatically.

Common mistakes Chinese cross-border sellers make:
✅ Zero filing for empty LLC/C-Corp companies against 1099-K records
✅ Manually force balance data without cost reconciliation statements
✅ Mix SSN and EIN leading to tax filing errors

Sino-US data exchange makes double-side tax evasion impossible.
We provide US company bookkeeping, 1099-K reconciliation, back tax amendment .
