CAN YOU FIRE AN EMPLOYEE IMMEDIATELY IN POLAND?
Yes, but only in specific situations! And getting the procedure wrong can create serious problems for the employer.
3 KEY SITUATIONS:
1️⃣ SERIOUS BREACH OF DUTIES
An employee seriously violates basic employment duties - for example, serious misconduct connected with their work responsibilities.
2️⃣ CRIME OR LOSS OF REQUIRED QUALIFICATIONS
Immediate termination may also be possible when an employee commits a qualifying crime that prevents them from continuing in their position, or culpably loses qualifications required for the job.
3️⃣ LONG-TERM ABSENCE
In certain circumstances, an employer may terminate the contract without notice because of prolonged illness or another sufficiently long justified absence. The statutory periods depend on the employee's circumstances and seniority.
BUT HERE'S THE IMPORTANT PART:
“Immediate dismissal” does NOT mean “no paperwork”.
The employer must follow the required formal procedure, including a written statement and appropriate information concerning the employee's right to appeal. In applicable cases, trade-union consultation may also be required.
And remember: disciplinary termination generally cannot be made more than 1 month after the employer learns about the reason for dismissal.
