1. SHARE IN DADA’S PROPERTY (Paternal Grandfather)

If a child’s father dies before Dada, then:

✅ SUNNI LAW (Hanafi – majority in Pakistan)

Grandchildren do NOT automatically inherit.
This is the rule:

> “A pre-deceased son’s children are blocked (محجوب) by the surviving sons of the deceased.”

✔ They will get a share only if:

Dada has no surviving son, and

No other sharer blocks them.

If Dada has other living sons, then grandchildren (orphaned children) get nothing from Dada’s estate under Sunni law.

✔ Practical Example

If Dada dies leaving:

1 living son

Children of 1 deceased son
➡ The living son gets everything.
➡ The grandchildren get 0.

✅ SHIA LAW (Jafria Law)

Shia law follows the rule per stirpes (by representation).
Meaning:

✔ If a son dies before Dada, his children take his share.

So grandchildren are never excluded.

✔ Example

If Dada had 2 sons:

Son A (alive)

Son B (deceased, left 2 children)

Estate is divided in 2 equal parts:

Son A → 1/2

Children of Son B → 1/2 (shared equally)

🟦 2. SHARE IN NANA’S PROPERTY (Maternal Grandfather)

This applies to both Sunni and Shia law:

If the mother dies before Nana, her children DO inherit in her place.

✔ Children take their mother’s share fully.

There is no blocking of maternal grandchildren in Sunni or Shia law.

Example

Nana dies leaving:

1 daughter (alive)

1 daughter (deceased) → left 2 children

Estate is divided:

Alive daughter → 1/2

Children of deceased daughter → 1/2 (shared equally)
