BIR SUSPENDS FIELD AUDITS AND OPERATIONS!

The Bureau of Internal Revenue (BIR) has just released Revenue Memorandum Circular (RMC) No. 107-2025, announcing a major suspension of audit operations.

If you have a pending Letter of Authority (LOA) or are worried about an upcoming audit, here is what you need to know about this new directive.

WHAT IS HAPPENING? Effective immediately, the BIR has ordered the suspension of all ongoing field audits and related field operations.

This covers the issuance of Letters of Authority (LOA), Mission Orders (MO), and the examination/verification of books of accounts and records.

WHY THE SUSPENSION? The BIR is conducting a comprehensive review of its policies to address systemic issues and protect taxpayers from irregular or intrusive audits. The goal is to develop a more transparent and standardized audit framework.

EXCEPTIONS (Operations that will CONTINUE) While general audits are paused, the BIR will still proceed with the following specific cases:

Prescribing Cases: Investigations of cases that will prescribe within six (6) months.

One-Time Transactions: Processing of Estate Tax, Donorโ€™s Tax, Capital Gains Tax, and Withholding Tax on the sale of real properties or shares of stocks.

Retiring Businesses: Examinations required for business retirement/closure.

Criminal Probes: Active criminal investigations supported by intelligence reports or third-party data validation.

Tax Refunds: Claims where an LOA is required by law.

Deadlines: Matters with specific deadlines imposed by the Commissioner.

IMPORTANT REMINDERS

Collections Continue: The suspension only applies to audits. The issuance of Assessment Notices, Warrants, and Seizure Notices for established liabilities will continue.

Voluntary Payment: You can still voluntarily pay known deficiency taxes without needing approval.

The suspension remains in effect until officially lifted by the Commissioner.

Stay tuned to our page for more updates on how this affects your business compliance!
