Did you know that Exemption for Petroleum Businesses is real?
There is a specific exemption under the Local Government Code:
Businesses engaged in the production, manufacturing, refining, distribution, or sale of oil, gasoline, and other petroleum products are exempt from local business tax (LBT) imposed by the LGU.
Legal Basis: Section 133(h) of the Local Government Code (Republic Act No. 7160) restricts LGUs from levying excise taxes or local business taxes on petroleum products.
Scope: The exemption covers the sale of diesel fuel and other petroleum-based products.
Coverage: This includes businesses that produce, manufacture, refine, distribute, or sell oil, gasoline, and other petroleum products.
Supreme Court Ruling: The Supreme Court (in G.R. 187631) has affirmed that LGUs cannot impose local business taxes on petroleum products, confirming this limitation on local taxing power.
