More Australian companies are failing than at any time on record. ASIC data shows 14,722 companies entered external administration in 2024-25, up 33% on the previous year.

The good news is that recent ASIC reviews of Small Business Restructuring and Voluntary Administration show that businesses that act early and seek advice sooner achieve significantly better outcomes than those that wait until options have run out.

Small Business Restructure Case Study ๐Ÿ“š

๐Ÿ”จ Background: A regional NSW trades business had historically operated a viable, profitable model. Short-term cash flow pressure built up from two compounding events: an extended business partner buyout that carried unresolved costs and uncertainty for around 18 months, and a run of severe weather that disrupted work.

๐Ÿ’ต The proposal: An upfront lump sum shortly after acceptance, followed by two further instalments over the next 12 months, funded by a related party, providing an estimated return to creditors of 33.9 cents in the dollar.

๐ŸŒ… The outcome: Creditors voted to accept the Plan. The company continues to trade and retains its employees.

As noted above, the proposal is projected to return roughly 33.9 cents in the dollar to unsecured creditors, compared with an estimated 0 to 9 cents in the dollar in a liquidation of the same business. SBR isn't a fit for every business in financial difficulty, but where the underlying trading model is sound and directors act early, it can preserve value and provide a genuine reset.

๐Ÿ’ธAre you struggling to pay your suppliers on time?
๐Ÿ“ˆIs your tax debt creeping up?
๐ŸกAre you propping the business up with personal funds?

One can be innocent, several suggest strain and could mean your business is insolvent.

Speaking with an insolvency accountant early gives you options. Waiting rarely does.

If this sounds like your business, get in touch for a free, confidential chat about your situation and the options which are available to you.

If you advise SMEs, you often see it before the client does. The lodgements slipping, the balance creeping up, the conversation deferred to after the next job comes in.

Any one of these signs can have an innocent explanation. It's when several appear together that a business is often under strain.

That's usually the point to raise specialist advice, while the options are still open. If a client's position is worrying you, we're happy to have a confidential conversation.
